Part A — Participation Terms & Conditions
At Diving School Zeeland (a trade name of Expeditie 82 B.V., also "the dive school"), we organise diving and snorkelling activities for both non-certified and certified divers. To ensure these activities run smoothly and safely, we apply the following terms and conditions.
1. Participant
The participant is the individual who signs the registration form, or in the case of a minor, at least one parent, legal guardian, or custodian. By signing the registration form, you, as the participant, acknowledge and agree to these terms and conditions. You understand that these conditions are also for your own safety and benefit.
2. Activities
The activities (also referred to as "dives") you participate in as a participant include pool sessions, sheltered water dives or open water dives, including snorkelling, freediving, and recreational SCUBA diving. This includes introductory activities, training courses, guided dives, or independent dives (without direct supervision from a professional).
3. Medical questionnaire
All participants must be in good health to take part in activities organised by the dive school. As a participant, you acknowledge the importance of this and agree to inform the dive school immediately if there are any doubts or questions about this. You declare that you are fit and in good health, and that there are no medical objections to participating in diving, freediving, and/or snorkelling activities.
You confirm that you have received a medical questionnaire to assess whether a statement from a medical doctor is required. Participation is only permitted if your answers to the questionnaire do not require clearance from a medical doctor. If your answers do indicate the need for clearance, you may only participate if you can provide a valid written statement from a medical doctor. The dive school reserves the right to exclude you from participation if there are concerns about your physical or mental health.
4. Theft and damage
The dive school accepts no responsibility for theft, damage, or loss of personal belongings or items in the direct or indirect care of the participant. This applies to all activities, including transport to and from the dive location.
5. Minor participants
The minimum age for open water activities is 14 years. For minor participants, the registration form must also be signed by a parent, legal guardian, or custodian, who will be responsible for ensuring the minor understands the contents of the forms and any related documents, and acts accordingly.
6. Instructions
During all activities, you must strictly follow the instructions given by our diving professionals or any other staff member affiliated with the dive school.
7. No solo diving
Solo diving is strictly prohibited. You must remain with your assigned instructor, divemaster, and/or buddy at all times. You must descend and ascend together and only separate once back on land at the original entry point.
8. Diving within your limits
You always dive within the limits of your training and certification. The dive depth must never exceed your certification level (or the level for which you are in training) and shall in any case not exceed a maximum depth of 30 metres. You are jointly responsible for respecting these limits and are required to share relevant information about this with the dive school.
9. Dive equipment
Diving safety requires, among other things, that the complete set of equipment functions correctly. Any equipment provided by the dive school is regularly inspected. Nevertheless, you are responsible for checking that all equipment you take underwater — regardless of ownership — is functioning properly and safely.
10. Loss of equipment
You are responsible for any dive equipment provided to you. In the event of loss of any equipment or parts thereof, the replacement value based on retail prices in the dive shop will be charged.
11. Gift voucher
A gift voucher is valid for the specific activity stated on the voucher. The voucher has no cash value. A gift voucher is valid for one year from the date of issue shown on the voucher and can only be used during the diving season after booking an appointment. A gift voucher can only be used once. The full cost of the activity covered by the voucher must be paid at the time of booking. Gift vouchers cannot be refunded.
12. Cancellation policy
You may cancel a reserved activity free of charge up to five calendar days before the scheduled (first) dive day. If you cancel less than five days before the (first) dive day, a cancellation fee of €45 per person per dive will be charged. A confirmed booking can only be rescheduled — where possible and only by mutual agreement — to another date. If you cancel on the day of the activity, if a dive or course is interrupted or not started for any reason, or if it becomes clear on the day that you are unable to dive for medical reasons (see point 3), you are required to pay the full amount for the reserved activities. If the dive school needs to cancel an activity (for example due to weather conditions that make safe diving impossible, or an ill staff member), an alternative date will always be sought. Only when this proves impossible within the current season or within one year at most will any advance payments be refunded. An advance payment for a course is never refunded, as the dive school always incurs costs. Online theory lessons usually remain available to be completed at a later time.
13. Applicable law and amendments
These conditions are governed by Dutch law. We reserve the right to amend these conditions at any time. The current version is always available on our website.
Part B — Rental Conditions
We (Diving School Zeeland, a trade name of Expeditie 82 B.V., also the lessor or the dive school) rent out complete diving equipment and individual parts thereof to certified divers. To ensure that renting equipment is pleasant and safe for everyone, we apply the following conditions.
1. Valid certification
Equipment is only rented to divers with a valid diving certificate. When collecting the equipment, we ask for a valid ID and a diving certificate. Additionally, a renter must be 18 years or older, and a deposit is required.
2. Use and responsibility
The renter is responsible for the correct use of the rented equipment. Always handle the equipment carefully and use it only for its intended purpose: recreational diving within the limits of your training and experience.
3. Inspection and reporting of damage
Upon collection, the equipment is inspected together. You must satisfy yourself that the rented equipment is in proper working order and functions as expected. Always check the equipment yourself again before use. If in doubt, discuss this before using the equipment for a dive. If damage occurs during use or something does not function properly, report this immediately upon return. Damage due to improper use, negligence, or loss of equipment will be charged to the renter based on normal sales prices. In case of damage or loss, the lessor is entitled to withhold the deposit.
4. Return clean
We kindly request that the equipment be returned rinsed, clean, and as dry as possible. Return suits as you wear them (not inside out). If the equipment is returned dirty, we may charge cleaning costs, which will be deducted from the deposit.
5. Loss or theft
In case of loss or theft of (part of) the equipment, the renter is responsible for the replacement costs, based on normal sales prices. Therefore, never leave diving equipment unattended and ensure it is secured properly during all dives.
6. Timely return
Rent always applies to the agreed period. In case of late return without prior consultation, additional costs may be charged. These costs will be deducted from the deposit.
7. No rental of mask and mouthpiece
For hygienic reasons and for the diver's comfort, we do not rent diving masks or provide mouthpieces on the primary second stage regulator. You must purchase or bring these yourself. A well-fitting mask is an important part of the basic equipment and greatly contributes to the diver's enjoyment and comfort.
8. Dive cylinders and regulators
Cylinders are provided filled (approx. 200 bar). Indicate when booking whether you need a DIN or INT connection. Regulator sets are supplied with a primary second stage, octopus, submersible pressure gauge, and inflator hose. When renting a regulator set, we assume that the user is familiar with its use.
9. Rules and restrictions
- Lending prohibited: it is not allowed to rent or lend the rented diving equipment to third parties.
- Repairs: all repairs or replacements of (parts of) the diving equipment due to damage caused by improper use or negligence are at the renter's expense.
- Proof of report: in case of theft, the renter must provide proof of a police report.
10. Use of dust cap
It is the renter's responsibility to correctly attach the dust cap to the first stage regulator after disconnecting it from the valve. This prevents water and/or debris from entering the first stage. Maintenance costs for the entire regulator set due to water infiltration or debris are at the renter's expense.
11. Cancellation and deposit
In case of cancellation of a confirmed booking, a reservation fee of €3.50 per transaction will be retained. In case of cancellation less than 24 hours before the start of the (first) rental day, the full rental fee will be charged. The deposit will be refunded within seven working days after correct return, provided there is no damage, loss, dirty equipment, or late return. We may use the deposit to offset any costs. In case of cancellation, the deposit will be refunded.
12. Force majeure
If the lessor is unable to fulfil a confirmed booking due to force majeure, you will be informed as soon as possible. The full rental fee and the deposit will then be refunded. We are not liable for any consequential damages resulting from this.
13. Insurance
As a lessor, we are not liable for damage to or loss of the renter's personal belongings during the rental period. You are strongly advised to take out a diving insurance policy that covers personal liability and diving-related accidents. We accept no liability for damage, injury, or loss arising from the use of the rented equipment.
14. Applicable law and amendments
These conditions are governed by Dutch law. We reserve the right to amend these conditions at any time. The current version is always available on our website.
